In Primorye, according to the materials of the prosecutor’s inspection, criminal cases were opened on the facts of illegal mining, as a result of which the state suffered damage in the amount of over 60 million rubles
Article 11 of the Law “On Subsoil” establishes that the provision of subsoil for use is issued by special state permission in the form of a license. Thus, the current legislation in the field of subsoil use prescribes that the use of subsoil, including the extraction of common minerals, in particular sand and gravel, granite, sandstone and other stone for monuments and construction, is carried out only if the economic entity has the appropriate license, received in the prescribed manner.
In May – September 2015, the Primorsky Environmental Prosecutor’s Office conducted inspections of compliance with the legislation on subsoil use, the results of which revealed unauthorized mining of common minerals (categories of granite, sandstone and other stone for monuments and construction). So, these facts are recorded in quarries located in the area of the village. Filino of the Dalnerechensky district with a production volume of about 42,700 cubic meters. m, as well as in the Arsenyevsky urban district with a production volume of about 17,500 cubic meters. m
Based on the results of inspections of illegal quarries conducted jointly with employees of the Department of Natural Resources and Environmental Protection of the Primorsky Territory, the amount of damage caused to the Russian Federation as a result of mining operations was calculated, which totaled about 63 million rubles.
The audit materials were sent by the environmental prosecutor to the preliminary investigation bodies to resolve the issue of initiating criminal cases.
